Terms of Service

1. Acceptance of Terms

By accessing or using Wasambazie eCards ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users including event organisers and administrators.

2. Description of Service

Wasambazie eCards is a digital invitation management platform that allows registered users ("organisers") to:

• Create and manage events
• Add and manage guest lists
• Design and send digital invitation cards via SMS and WhatsApp
• Track invitation delivery status
• Check in guests using QR codes on event day

3. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials confidential
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Send unsolicited bulk messages or spam to phone numbers not associated with your events
• Use the Service to harass, threaten, or harm any individual
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service to violate any applicable local, national, or international law
• Impersonate another person or entity
• Use the Service to send messages containing illegal, defamatory, obscene, or offensive content

5. Guest Data and Messaging

When you add guests and send them invitations through the Service:

• You warrant that you have obtained the guests' phone numbers lawfully and that sending them event invitations is appropriate in the context of your relationship with them.
• You are responsible for the content of all messages sent through your account.
• You must honour any opt-out requests from recipients promptly.
• You must not use the messaging features for any purpose other than sending event-related invitations.

6. WhatsApp Business Platform

Use of WhatsApp messaging features within the Service is subject to Meta's WhatsApp Business Policy and Commerce Policy. You agree to comply with those policies when using WhatsApp features. We reserve the right to disable WhatsApp messaging for any account found to be in violation of Meta's policies.

7. Intellectual Property

The Service, including its software, design, and content, is owned by Wasambazie and protected by applicable intellectual property laws. You retain ownership of the event data and message content you create. By using the Service, you grant us a limited licence to store and process your content solely to deliver the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We will endeavour to notify users of planned downtime where possible.

9. Limitation of Liability

To the maximum extent permitted by law, Wasambazie shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to undelivered messages, loss of data, or missed event communications. Our total liability for any claim arising from use of the Service shall not exceed the amounts paid by you for the Service in the 12 months preceding the claim.

10. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service at any time if we determine that you have violated these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify registered users of significant changes via email or in-app notification. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Tanzania.
